Terms of Service
These terms are the agreement between you and Obrigado, LLC, the Delaware company that operates 5ki (“we”, “us”). By using the site you accept them. If you do not, please do not use 5ki.
What 5ki is
5ki is a service for publishing short public lists — a theme reduced to its most memorable points, five lines to a page. We may change, add, or remove features as the service develops.
Your account
- You must be at least 16 to create an account.
- Give accurate sign-up details and keep your access to your email secure. You are responsible for what happens under your account.
- Handles are first come, first served. We may reclaim a handle that impersonates someone, infringes a trade mark, or is being squatted.
Your content stays yours
You keep ownership of everything you publish. By publishing on 5ki you give us a non-exclusive, worldwide, royalty-free licence to store, display, and distribute that content for the purpose of operating and promoting the service — for example, showing your list on your page, on the front page, or in a link preview when someone shares it. This licence ends when you delete the content, except for copies already cached or shared elsewhere.
Only publish what is yours to publish. Do not post material you do not have the rights to.
What you may not do
- Publish anything unlawful, hateful, harassing, threatening, or defamatory, or anything sexualising minors.
- Post other people's private information, or impersonate anyone.
- Use 5ki for spam, scams, phishing, malware, or link schemes.
- Attack or abuse the service — scraping at scale, breaking or probing our security, inflating view counts, or automating account creation.
Everything you publish is public
Published lists, your handle, display name, and bio are visible to anyone and may be indexed by search engines. Treat the site as a public noticeboard, not a private notebook. See our Privacy Policy for what this means for your data.
The front page
Which lists appear in “Today's Top 5kis” is at our editorial discretion, informed by view counts and our own selection. Nobody is entitled to be featured, and being featured is not an endorsement.
Moderation and ending your access
We may remove content or suspend accounts that break these terms or the law. Where it is reasonable to do so we will tell you why. You may stop using 5ki and delete your content at any time.
The service is provided as it is
We work to keep 5ki available and accurate, but we cannot promise it will be uninterrupted or error-free, and we do not endorse or verify content published by users. To the fullest extent the law allows, the service is provided without warranties, and we are not liable for indirect or consequential losses, lost profits, or lost content. Nothing in these terms limits liability that cannot lawfully be limited — including for death or personal injury caused by negligence, or for fraud. Nothing here affects the statutory rights of consumers.
Links out
Lists often contain links to other sites. We do not control them and are not responsible for what they contain.
Changes to these terms
We may update these terms. The date at the top will change, and material changes will be signposted on the site. Continuing to use 5ki after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law rules, and the courts of Delaware have jurisdiction over disputes arising from them.
If you are a consumer, none of that takes away rights you have where you live. You keep the protection of the mandatory consumer laws of your own country, and you may bring proceedings in your local courts.
